May Birding – Best time of the year

Buff-breasted Sandpiper

A Buff-breasted Sandpiper, a rare "shorebird" that you normally don't find along the shoreline as they migrate through. Today was the exception to the rule though, as a flock was found on the edge of a shallow wetland.

May is such a wonderful time.  After a long South Dakota winter, May brings warm temperatures and green landscapes.  From a birding perspective, after a winter of very little species diversity, no other time of year can match the number and variety of species that you can see in a given day.  Shorebirds are migrating through the interior of the country, and a trip to a mudflat or shallow water area can easily yield a dozen or more shorebird species.  In eastern South Dakota where I live, we can have truly incredibly warbler migrations, with the possibility to see 20+ warbler species in a day.  The summer breeding birds also have all arrived by the end of the month, with Indigo Buntings, Rose-breasted Grosbeaks, Baltimore Orioles, Scarlet Tanagers, and more bringing a very welcome splash of color after a winter dominated by the cute, but gray/black/white Dark-eyed Junco.

Ovenbird

It's amazing how such a small bird as an Ovenbird can make such a loud noise! This time of year, their loud crescendo songs can be heard throughout Newton Hills State Park.

I always try to save some vacation days and go out on all day birding trips in May.  I went yesterday, and had a truly wonderful day.  The day started with a trip to Newton Hills State Park, about 30 miles south of Sioux Falls.  Newton Hills is a relative rarity for South Dakota habitats, a true “eastern” deciduous forest.  As such, it often holds eastern U.S. forest species that you’re unlikely to find anywhere else in South Dakota. It didn’t take long to hear singing Blue-winged Warblers, a species on the edge of its range in South Dakota.  Warbler numbers weren’t all that high compared to what they can be, but there was a nice mix.  American Redstarts were relatively common, and Yellow Warblers were everywhere.  One of my personal favorites, Ovenbirds, are quite common in Newton Hills and they were certainly doing their best to announce the arrival of spring, with their distinctive, loud songs.  Other warblers included Blackpoll Warbler, Common Yellowthroat, Wilson’s Warbler, Tennessee Warbler, and Northern Waterthrush.

Hudsonian Godwit

One of the most beautiful shorebirds that migrates through the state, a male Hudsonian Godwit.

It was also nice to see all the summer “regulars” at Newton Hills.  Scarlet Tanagers, Rose-breasted Grosbeaks, Indigo Buntings, singing Wood Thrush, Red-eyed and Yellow-throated Vireo…all welcome for both the views and for their songs.

After Newton Hills, I headed up towards the Lake Thompson area in Kingsbury county, looking for waterbirds.  Lake Thompson never disappoints in the spring.  It’s so large, and no matter the water levels for a given year, you’ll always find mudflats and shallow waters that hold shorebirds, as well as deeper water for other birds.  The highlight was a Little Blue Heron, a bird more often thought of as a bird of the southeastern United States. It was hanging out with a group of about a dozen Snowy Egrets, and is only the 2nd Little Blue Heron I’ve ever seen in the state.  Another highlight were a group of at least 18 Buff-breasted Sandpipers.  They are a pretty rare migrant to begin with and are always a welcome sight, but it’s not often you see a large group of them.  They’re normally found in short-grass areas, but at least yesterday, this flock was acting like other “shorebirds”, hanging around the edge of a shallow-water lake.

Little Blue Heron

A bird you associate more with the Gulf Coast than you do South Dakota, this is only the 2nd Little Blue Heron I've ever seen in the state.

On the grasslands and fence lines, both Eastern and Western Kingbirds had returned, while Bobolinks were seen, and heard, singing their unique, metallic/clinky songs.

Wonderful day, both for the variety of birds seen, from forests, to grasslands, to wetlands, but also for the surprise of seeing some rarities for the state.  Gotta love May birding in South Dakota!

When a Scandal…Isn’t…

I’m finding it increasingly hard to read the “news” lately.  What qualifies as “news” has already changed significantly in the last few decades, as “news” websites and “journalists” seem to increasingly focus on the trivial, on the provocative, and on the scandalous, regardless of “news” worthiness.

In the world of D.C. politics, “scandal” has similarly become focused on the provocative, political, and trivial.  With the extreme polarization of Repubs and Dems, it seems our elected Representatives and Senators are more interested in finding “gotcha” moments to score political points than they are in actually governing.  Politicians are more interested in seeking the short-term limelight of the attention garnered through uncovering of “scandals” than they are in the long-term benefits of legislating.

According to the “news” sources, we have three major “scandals” occurring right now; Benghazi, the IRS, and the Justice Department/AP.  Especially given the involvement of the AP in the Justice Department investigation, a riled-up media has played up the three “scandals”, doing their best to make them as provocative as possible to an ignorant and easily fooled public.

Dig a little deeper, and its damned hard to get too worked up about the major “scandals”.  PERHAPS if Republicans in the House would focus on legislating and solving the issues, rather than just trying to score political points, I could take them seriously.  However, Republicans have turned the “scandals” into personal witch-hunts, desperately trying to directly link the “scandals” to the current Obama presidency, and a possible NEXT Democratic presidency of Hillary Clinton.  Benghazi was a tragedy, and people died.  In the world of D.C. politics, the focus isn’t on correcting the situation and trying to improve security.  GOD no…in fact, Republicans continue to be against any increases in funding for diplomatic security.  Instead, Benghazi, like the other scandals, is primarily about the next election instead of being focused on preventing another Benghazi.

Immigration reform?  Entitlement reform? Increasing unrest in the Middle East? Deficit reduction? Health care?  With the current focus on “scandal”, Congress seems like they couldn’t care less about the more pressing issues facing the country.

“Gotcha” journalism now has a VERY willing partner in “gotcha” D.C. politics.

Hate D.C. Politics? YOU THE VOTER are to blame

Unbelievable…

I’m finding it increasingly difficult to blame politicians themselves for much of the ridiculous happenings in D.C.  After all, they can’t get to D.C. unless they win an election.

As tonight’s special election results in South Carolina so CLEARLY indicate…Americans are the most hypocritical, ignorant voters on the planet.  Disgraced South Carolina Governor Mark Sanford won a special election for a House seat tonight.  The man went through an incredibly scandalous affair, he used public funds to fly to Argentina to meet his mistress, he lied about his activities, and since leaving office in disgrace, he has had his wife accuse him of stalking.

And of course…he WON the election tonight!  Interviews have shown South Carolina voters who didn’t like Sanford’s behavior voted for him because of his party and what it stood for.  Hey, after all, it’s REPUBLICANS who try to claim the moral high ground!  It’s REPUBLICANS who have somehow garnered majority support from the bible-thumpin’ crowd!

But yet when push comes to shove, the same Republicans re-elect a lying, cheating, disgraced former politician, because of his PARTY and what that party supposedly stands for!?!?  Unbelievable.

Yes, Washington D.C. IS a complete mess.  But it’s also abundantly evident that the idiots in Washington are PERFECTLY representative of the idiocy of Americans in general.

We have nobody to blame but OURSELVES for what goes on in Washington…

Good Jobs Report – Republicans Upset

Last month’s jobs report was abysmal, much lower than analysts expected.  After many months of improving numbers, it certainly was a downer, and prompted some to speculate that either the recovery had stalled, or even that we were headed back into recession.  Yesterday, the latest job’s report came out, and the numbers were not only solid, but revisions to the past 2 months numbers pushed those jobs numbers markedly higher.

All in all…very good news!  Wall Street certainly reacted to the jobs report as a great sign the economy is recovering.  The Dow temporarily topped 15,000 for the first time, and finished at an all-time high.  The pundits wrote about the jobs report as good news, a sign that the “spring stall” we’ve had in recent years wasn’t nearly as much of a threat this year.

So how did Republicans react?  As they ALWAYS do when ANYTHING good happens under the Obama presidency…by loudly pronouncing the darkest, most pessimistic interpretation of the news, and then squarely placing “blame” on the Obama administration. RNC Chairman Reince Priebus said that thanks to ObamaCare, future jobs numbers are “more likely to slow down than speed up”.  Cheery. John Boehner’s quote?  “We need to seize opportunities the president has been ignoring, and focus on growing our economy rather than growing more government”.    Fox News?  While every other major news website had a story about the good jobs report yesterday morning, on Fox News’ website, the jobs report was curiously absent from the front page.  Shocking!  A “news” organization (ha-ha) ignoring good news for Americans?

It must be awfully damn depressing to be a Republican right now.  Republicans are SO full of hate for this president that even GOOD news must be interpreted in a negative light.  Republicans, is there ANYTHING you enjoy in life?  Is there ANY good news that you don’t somehow turn around into an Obama negative?  Is this how Americans are supposed to live their lives, focused on hatred, negativity, and pessimism about the future?

Pat Toomy, Republican Senator and co-sponsor of the Manchin-Toomy gun-control bill that recently failed, said the bill failed because “There were some on my side who did not want to be seen helping the president do something he wanted to get done, just because the president wanted to do it.” That’s a shockingly honest, but shockingly depressing statement.  Republicans have become SO incredibly ideological that they don’t even CARE about the direction of the country.  The don’t CARE about a good jobs report.  They don’t CARE that the economy is improving.  Even with 90% of Americans supporting background checks, Republicans ADMITTEDLY voted against it, just because they don’t want to do something Obama supports.

Republicans would rather see the entire country collapse, so they can point their fingers and blame Obama.  What a pathetic party platform. What an incredibly sad way to live your life…

Harvey Potts – Photographer / Thief Extraordinaire

Harvey Potts - Photo Thief

A photo of a "Pygmy Owl" supposedly taken by Mr. Harvey Potts in Green Valley Arizona. IN reality? It's MY PHOTO, taken near Tucson Arizona, and is of an ELF OWL.

If you get a chance check out the wonderful photography on Harvey Potts website.  He’s got some truly beautiful photography.  Gorgeous nature photography, beautiful landscape shots, photos of old bridges and barns…he has a really diverse set of photos.  I’m particularly amazed by the quality of some of the nature photos.

I’m amazed that he was able to PERFECTLY replicate, down to the pixel level, shots taken by other photographers!!  IMAGINE the patience and determination it must take, to find someone else’s photo online and try to recreate it! Traveling to the location, finding a bird that is EXACTLY the same, positioning it EXACTLY the same, waiting for EXACTLY the same lighting conditions…what amazing devotion to his “art”!!  What an INCREDIBLE photographer!!

Elf Owl - Terry Sohl

MY Elf Owl photo on my website, taken on the outskirts of Tucson Arizona. Mr. Harvey Potts just cloned out my name and copyright symbol, and placed on his photography website as his own.

For example, look at this “Pygmy Owl” photo above, supposedly taken in Green Valley, Arizona.  Now compare to this ELF OWL photo that I TOOK near Tucson Arizona.  Note the attention to detail!! Note the PERFECT replication of nearly every detail from my photo!! In fact, the ONLY difference between the photos is that Mr. Potts digitally removed my name and copyright symbol from the photo!!!  AMAZING WORK, Mr. Potts!!!

Pretty “ballsy”, Mr. Potts!! If you have a public website with displayed photos, those photos WILL be used by others without your permission.  It’s a fact of life, and something any photographer with a website should expect.  I’ve been absolutely amazed at how often I run across my own photos.  Usually, it’s something like a blog where somebody wanted a bird photo for a blog post, but even in my work at the U.S. Geological Survey, there have been a number of times where I’ve gone to a conference, and seen my photos pop up in other scientists’ presentations and on their posters of their work.

It’s damned annoying when people use your photos without permission, particularly when you clearly define usage limits on your website, but Mr. Harvey Potts has taken it to an entirely new level!  A supposed PHOTOGRAPHER, displaying photos from OTHER PHOTOGRAPHERS on his own personal website and claiming they are his own!! This Elf Owl is NOT the only stolen image.  Another photographer noted their images stolen, and Mr. Potts even had the nerve to put his OWN NAME AND COPYRIGHT symbol on the stolen photo.

Mr. Potts, you are TRULY a piece of $hit.  Displaying and marketing photos from other photographers as your own?  That goes WELL beyond simply using someone else’s photo for a blog post.

Did you take ANY of the photos on your site?  Do you even KNOW how to use a camera?

Fortunately, I am QUITE sure my website gets much more traffic than yours, Mr. Potts. I sincerely hope anyone searching for the “WONDERFUL” photography of Mr. Harvey Potts ends up finding this blog post.  You, Mr. Potts, are one despicable piece of crap.

Review – “The World’s Rarest Birds”

The World's Rarest BirdsThere are books that are a struggle to get through, books that are forgotten the moment the last page is read.  There are the rare books that you may read cover-to-cover multiple times.  There’s another class of books that to me truly fit under the category of “coffee table book”, books that you will occasionally pick up and casually browse through.

The World’s Rarest Birds” by Erik Hirschfeld, Andy Swash, and Robert Still, squarely fits in the last category.  The World’s Rarest Birds is a follow on project to the “Rare Birds Yearbooks“, publications that highlighted the 190 most threatened birds in the world, those considered to be “critically endangered”.  The World’s Rarest Birds is an effort to expand on the idea of the Rare Birds Yearbooks. The book is based on the periodic assessments by BirdLife International and the International Union for the Conservation of Nature (IUCN), assessments that provide summaries of the world’s bird species and their conservation status.  This book highlights critically endangered and endangered species from the May 2012 assessment, as well as a number of species whose status is poorly known, for a total of just over 600 species.

The book’s format is very straightforward, with introductory segments that talk about the concept of the book and the specific threats faced by bird species.  The majority of the book, however, is devoted to “regional directories”, sections devoted to summaries of endangered bird species from each of the continents and Oceania. Each species has a paragraph that describes the species, its range, and conservation threats.  Distribution maps are included for each species, and most of the species have corresponding photographs.

And what photographs they are! As a bird photographer, I can certainly appreciate a good bird photograph, and understand the tremendous effort that must go into capturing high-quality photos of the world’s rarest bird species.  The book is a true delight to page through, with the small photos accompanying most of the species accounts interspersed with large, gorgeous, full- or partial-page photographs.

This isn’t a book that you’ll sit down with and read cover-to-cover.  While the regional presentation does attempt to help maintain a semblance of a “story” to the book, it does indeed fit the category of “coffee table book”, one that you’ll keep in a handy spot and reference from time to time, a book you can page through and enjoy with a cup of coffee or while you watch TV.  The World’s Rarest Birds is book you’ll be glad to own, particularly if you have an interest in bird conservation and enjoy high-quality nature photography.

Wilson’s Phalarope – Spinning Fools

Wilson's Phalarope - Phalaropus tricolor

Still from a video of a very large flock of "spinning" Wilsons' Phalarope. See below to view the YouTube video.

What an incredible, LOOOOONG winter it’s been.  It’s May 1st…and we’re supposed to get 2 inches of snow today.  In mid-April, we had the biggest ice storm I’ve ever seen, resulting in 3 days where my work was closed, and 4 days of school being closed.  Since mid-April we’ve had significant snow about 3 times.

Sunday I went birding for a bit.  April 28th…and there was still ICE on parts of the lakes where I was birding.  Unbelievable.  From a birding perspective, it’s certainly been an odd spring, as “winter” species have hung around well past their normal departure times, and some of the early spring migrants have stacked up in the region, waiting for a thaw further north so they can resume their migration. Just last week, during (yet another) snow storm, at my feeders I had the incredibly odd mix of a Rose-breasted Grosbeak (summer bird!), scads of Dark-eyed Juncos (Winter!), a Pine Siskin (Winter!), and Red-winged Blackbirds (bird I’ve never seen in my yard). I’ve had “winter” sparrows (American Tree Sparrows) foraging right alongside “summer” sparrows (Song Sparrows and Chipping Sparrows) below my feeders.  Weird, weird, weird.

Sunday was a warm, “normal” spring day, and despite the ice still hanging around the lakes in Lake and Kingsbury counties, there were quite a few birds.  I specifically was looking for shorebirds, and in a normal year, we’d have quite a few around.  However, despite a lot of waterfowl, gulls, pelicans, cormorants, and wading birds, there were hardly any shorebirds.  The one exception?  A massive flock of Wilson’s Phalarope on the “highway 81 lakes” north of Madison, South Dakota.

Wilson’s Phalarope are a personal favorite of mine.  They are rather pretty birds, and are unusual in that it’s the female who is the more colorful.  While pretty, it’s not their looks that makes them a favorite of mine, it’s their behavior.  Wilson’s Phalaropes, like other Phalaropes, often feed by “spinning”.  They swim in very tight circles on the surface of the water, and it’s thought the spinning action brings up small food items from below, close to the surface where the Phalaropes can grab them with their bill.

Wilson’s Phalarope do breed in the area, but when breeding, they’re not as visible and you don’t see them in numbers.  On this trip, I saw the largest flock of Phalaropes I’ve ever seen…at least 1,000 birds, and they were all doing their mad spinning in the shallows.  I never, and I mean never, video birds, but for some reason I had my little video camera with me and really wanted to document their behavior.  I pulled onto a tiny abandoned driveway next to the water, and was at first disappointed when all the birds flew away.  However, as I sat there, the circling flock slowly began to return, with small groups landing in the water many yards from shore.  After 20 minutes or so, they’d largely “forgotten” about the guy sitting in his car, and the entire flock was spinning like crazy on the water’s surface, just a few yards from where I sat.

Fun day, and very cool to capture it on video.  Here’s a YouTube link to the video of the “spinning” Phalaropes:

War Weary – Syria Next?

We’re about to find out how seriously Obama was when he said Syria’s use of chemical or biological weapons would be “crossing a line”, and would trigger action by the United States.  Personally, I don’t see much of a difference between the Syrian regime using bullets, bombs, or chemical weapons, the net effect is still the same.  Assad’s regime is still murdering its own citizens as it tries to cling to power.

I find it strange how people react differently to HOW an atrocity is committed.  Just yesterday, 5 people are killed in a shooting rampage and a young girl is hospitalized in Illinois, and the headlines continue be dominated by the Boston bombing that occurred 10 days ago, where 3 people were killed.  In Syria, I guess it’s OK for Syrian troops to bomb its own citizenry.  I guess it’s OK for snipers loyal to Assad to make simply appearing in public a life-or-death gamble.  How many thousands of Syrians have died or been injured in the last 2 years?  THAT evidently isn’t enough to trigger American action, but at the first sniff of “proof” of chemical weapons usage, and the (Hairy Old White Men) hawks are calling for war.

Geography also obviously plays a role in what level of “outrage” Americans express over atrocities committed overseas.  There’s a definite hierarchy!  Trouble in the Middle East?  We’ve got oil interests there!  Genocide in Rwanda?  Genocide in Sudan?  Eh…barely registers on the political radar in America.

So what will Obama do?  With Americans weary of war, with the Middle East weary of American boots on the ground in the region, I can’t believe we’d ever become involved in any significant ground-based operations to oust Assad.  Supplying weapons and air support for rebels certainly seems like a strong possibility now, something that would have likely never happened without “proof” of chemical weapons usage.

In the meantime, the same ol’ Washington crowd has been beating the war drums.  I sympathize with the Syrian rebels.  But, like most Americans, I weary of the constant state of war, I weary of the constant military involvement in the Middle East.  I weary of an American military that accounted for 40% of ALL global military expenditures last year.  I weary of a “culture of war”, where military intervention is seemingly the action of choice for many in Washington. I weary of American’s self-imposed role as the World’s Policeman.  I weary of a world where there’s constantly a NEED for a “World’s Policeman”.

You have a tough decision ahead, Mr. Obama.

Wayne LaPierre and the NRA – The True Terrorists

It certainly has been interesting seeing the aftermath of the Boston bombings, the hunt for the suspects, and the reactions after one was killed and the other captured.  I’m not trivializing the bombing.  It’s horrific event, perpetrated by a couple of very screwed up, evil men.  However…in what many are calling the first “terrorist” killing in the U.S. since 9-11, there were 3 people hurt, along with several score injured.

On April 15th, the day of the bombing, there were ELEVEN Americans killed by guns.  The day after, on Tuesday, there were FOURTEEN Americans killed by guns.  The next day?  FIFTEEN gun deaths.  And so on…and so on…and so on.  Over 3,500 Americans have died due to gun violence, JUST since Newtown happened in December…a four month period.  That’s an average of about 30 deaths per day.  Gun deaths in the United States routinely top 12,000 a year, and nobody bats an eye.  An AVERAGE day in America and many more are killed by guns than were killed by the one “terrorist” event in the United States since 9-11.

But then again…what constitutes a “terrorist”?  If a Muslim guy blows up a bomb at a marathon?  You bet, says America!  It’s “terrorism”!  It’s a no-brainer!  A bomb is involved, and a Muslim is involved!!

But what if a young white man who is NOT Muslim commits mass murder?  Is it called “terrorism” by the press?  Are there calls to suspend Miranda rights?  Are there calls to suspend due process under the law?  No.  If a white NON-MUSLIM commits mass murder, it’s a mental health issue, the act of a troubled young man. It’s NOT ever labeled as “terrorism”.  An young guy equally as troubled as the Tsarnaev’s from Boston walks into a grade school in Newtown and takes the lives of over 20 young children, a death toll that far surpasses Boston, but the “terrorism” label was never applied to that case.

So again…what constitutes ”terrorism”?  What consitutes a “terrorist”? ”Official” definitions for “terrorism” usually infer violence with a political purpose.  However, in America, since 9-11, it seems that the term “terrorist” has unfortunately taken on religious connotations, with the religious background of the person evidently more important than the crimes that were committed.  Were there any political claims made by the Tsarnaev brothers for the Boston bombings?  Wouldn’t a “terrorist” claim responsibility in the name of a cause?  The Tsarnaev’s certainly didn’t attempt to claim responsibility, and certainly didn’t pronounce the bombing was for some political cause.  However, the event is widely labeled as “terrorism”, a label that has become further entrenched in Americans’ minds after it became known the brothers had at least some involvement in the Islamic faith.

It’s sad that we can spend SO much time and energy focusing on controlling “terrorism” in the United States, but completely ignore “everyday” violence that claims the lives of MANY thousands more Americans than does “terrorism”.

If “terrorism” can be defined as a “violence with a political motivation”, then America is FULL of (as yet) unrecognized terrorists.  Look at how political the issue of gun control has become.  Even a simple, sensible, straight-forward piece of legislation to increase background checks and keep guns out of the hands of criminals and the mentally ill is turned into a political argument.  When I see THOUSANDS of Americans being killed every year by gun violence, I see MANY violent deaths that are ultimately due to political motivations.

With THOUSANDS of highly preventable gun-violence deaths in America each year, if we are to follow the standard definition of “terrorism”, those that ENABLE those gun violence deaths should be defined as “terrorists”, just as those who provide bomb-making equipment and training are considered as “terrorists”.  If “Violence ultimately due to a political motivation” is the definition of a “terrorist”, then there’s little doubt that Wayne LaPierre, the head of the NRA, should be considered the most dangerous “terrorist” in America.  Thanks to the efforts of LaPierre and the NRA, criminals and violent mentally ill persons can easily obtain weaponry that no other Western culture allows such easy access to.

Boston was a sad event to be sure.  The Tsarnaev brothers were sick, evil human beings.  But it’s stunning to me that Americans can tolerate the equivalent of 10 Boston bombings  PER DAY in America, in terms of deaths due to gun violence, and not get nearly as worked up as they do about a once-in-a-decade event.

Troubling Issues from Boston…

In the wake of the Boston Marathon bombings and subsequent capture of one of the perpetrators, some troubling issues have arisen.  Senators John McCain, Lindsey Graham, and other Republicans (of course) are calling for Dzhokar Tsarnaev to be held as an “enemy combatant”.  Can you claim the bombing was “terrorism”?  Of course. However, this isn’t a foreign national in custody…it’s an American citizen.

The kid is scum…he deserves to punished under the full weight of the law.   I can’t imagine why ANY human being would do the acts he’s accused of. Given the evidence, there currently appears to be little chance of him escaping at least a lifetime in prison.  The issue about how he’s being treated under the law isn’t about Dzhokar Tsarnaev himself, it’s about American ideology.

The Tsarnaev brothers certainly turned Boston upside down and instilled a lot of fear in folks.   I just hope that fear doesn’t cloud people’s judgement about what America stands for.  This ISN’T Russia.  The Tsarnaev’s left Chechnya to escape an oppressive regime, one where brutality and lack of due process under the law were threats to all who opposed government control.  I don’t know why they turned to such a despicable act, but it would be ironic if their presence and crime in America moved OUR justice system towards a system more like Russia’s.

Watching the news coverage of the events, I can’t also help but be concerned about the media’s (and public’s) fixation on their religious status.  The younger brother in custody is an American citizen.  I would bet the farm that he WOULD have been read his Miranda rights, that he WOULD have been treated as a normal “criminal”…if he hadn’t come from Chechnya, and ESPECIALLY if he hadn’t had indications of ties with the Muslim faith.

I understand the concern about further danger, and of course authorities want to know whether there are any other collaborators or any other explosive devices that may be out there.  However, to me, it’s (yet another) act of mass murder committed by an American citizen.  While his background should indeed be relevant to the investigation, it should NOT drive how he is treated under the law.

Read the scum his Miranda rights, charge him in the criminal courts, and let him spend the rest of his miserable life in high-security prison.  Treating an American citizen as an “enemy combatant”, even a scum like Dzhokar Tsarnaev, just means that the Tsarnaev’s have won.
